Acquitted because the fact does not constitute a crime. The legal case involving Antonio and Gianluca Tanda, administrator and president of Turris Sleeve, accused of fraud, ended in court in Sassari, last Wednesday.

A process born following the 400 thousand euro financing provided in 2017 by CFI, Cooperazione finanza e impresa soc. coop per azioni, implementing body of the Mise, in favor of the company that was supposed to produce plastic film – the industrial film called “sleeve” – with which to wrap the bottles.

An innovative process that, at the time, was supposed to be able to create much thinner, better printable and more recyclable products and that had also attracted the attention of Coca-Cola. Turris Sleeve signed a contract with SardaLeasing in 2016 regarding the leasing of the industrial product production plant. Also in 2016, CFI granted the financing on the condition that, first, the granting of the pre-amortization by SardaLeasing would be verified and, as a second condition, the “start of production of the “films” for potential customers” would be ascertained.

According to the charges, the Tandas had misled both SardaLeasing and Cfi with two appraisals, produced between June and November 2016, which certified the quality of the product and the machine, which was supposed to produce heat-shrink sleeves as per the contract, validating the ongoing procedure. “Without finding any anomalies whatsoever – the first appraisal reported, for example – except for elements related to the normal set-up of a system during its first installation”. According to the indictment, the reports were “a false report drawn up for the sole purpose of allowing the disbursement of the subsidized loan and certifying the operability of the Turris Sleeve”.

The two experts were also charged with the crime of ideological falsehood in conjunction with the Tandas, who were acquitted both in the summary trial and on appeal, while the trial for the Tandas remained standing with the ordinary procedure. In the discussion, the prosecutor Ilaria Achenza had requested full acquittal because the fact does not exist, while, as written, the judge Claudia Sechi ordered the acquittal “because the fact does not constitute a crime”. The lawyer Liliana Pintus defended the two defendants, while Luigi Esposito assisted the civil party.
